POWPO stands for possession of a weapon by a previous offender. It makes firearm possession a crime for someone with a prior felony conviction, charged as a class 6 felony by default and a class 5 felony when the weapon is a dangerous weapon or the prior conviction was for burglary, arson, or a felony involving force or a deadly weapon. These cases frequently turn on whether you actually possessed or controlled the weapon, which is a live question in shared homes and vehicles.

Can I be charged for a gun that was not mine?

Yes. Colorado recognizes constructive possession, meaning the prosecution can charge you for a firearm found in a vehicle or residence you had access to and control over, even when it belonged to someone else.
